RootLock Terms of Service

These Terms of Service ("Terms") are an agreement between you and Apexium Marketing LLC ("Apexium," "we," "us") governing your use of the RootLock app and related services ("RootLock"). By creating an account or using RootLock you agree to these Terms and to our Privacy Policy.

1. Service Description

RootLock is a family safety service. Depending on your family's setup and each member's role, it provides: a live family map with saved places and arrival/departure alerts; automatic drive detection with routes, safety events, and drive scores; a family activity feed; check-ins and SOS alerts; and parental controls — app and website blocking, web filtering, downtime schedules, temporary access grants, protection (tamper/bypass) alerts, and a parent-set PIN that gates a child's ability to sign out. Protection features are built on Apple's Family Controls and Screen Time frameworks and enforce on the child's own device.

2. Subscription Terms

• RootLock requires a RootLock Family subscription: $9.99 per month or $44.99 per year (prices in USD; local pricing may vary and is shown in the App Store at purchase). One subscription covers your entire family.
• New subscribers receive a 14-day free trial. If you do not cancel before the trial ends, the plan you selected begins and renews automatically until cancelled.
• Payment is charged to your Apple ID through the App Store. Manage or cancel anytime in your device's Settings → [your name] → Subscriptions; cancellation takes effect at the end of the current billing period. Refunds are handled by Apple under App Store policies.
• If a subscription lapses, safety and protection features may stop functioning until it is renewed.

3. Accounts and Roles

• Accounts are created with Sign in with Apple. You are responsible for the accuracy of the information you provide and for the devices signed in to your family.
• Families have three roles: parent (creates the family and manages members), co-parent (an equal adult partner in managing children), and child. Members join only through invite codes generated by a parent.
• Adults control what they share with each other (location, activity, emergency group) through in-app settings.
• Children cannot remove themselves from a family or sign out without a parent (via the parent-set PIN or removal by the parent).

4. Acceptable Use

You agree to use RootLock only for its intended purpose: safety within your own family. You must not:

• track or monitor any adult without their knowledge and consent — adults join your family and configure their own sharing;
• use RootLock to monitor a child you do not have legal authority over;
• attempt to access another family's data, probe or disrupt the service, or reverse-engineer it except as permitted by law;
• use SOS or check-in features to send false alarms.

We may suspend or terminate accounts that violate these rules.

5. Consent Requirements

By adding a child to your family and setting up their device, you represent that you are that child's parent or legal guardian and consent to the collection described in the Privacy Policy. By joining a family as an adult, you consent to the sharing you configure in your settings.

6. Safety Disclaimer — Not an Emergency Service

• Location accuracy and freshness depend on the device, its settings, battery, and network conditions. Locations can be delayed, imprecise, or unavailable.
• SOS alerts, check-ins, and notifications require working connectivity on both the sending and receiving devices and can be missed, delayed, or undelivered.
• Drive detection and safety events are best-effort estimates derived from device sensors and may miss trips or report inaccurately.
• App and web protection depends on Apple's frameworks and device settings; determined circumvention, OS changes, or device tampering may defeat it. RootLock detects and reports tampering where possible but cannot guarantee prevention.

7. Service Availability

We aim for reliable service but do not guarantee uninterrupted availability. Features may change as Apple's operating systems and frameworks change. We are not liable for data loss; missed, delayed, or undelivered notifications; or operating system behavior changes affecting app function.

8. Limitation of Liability

To the maximum extent permitted by law, Apexium will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any harm arising from reliance on RootLock's location, driving, alerting, or protection features. Our total liability for any claim will not exceed the total subscription fees you paid for RootLock in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Intellectual Property

RootLock, including its software, design, and branding, is owned by Apexium Marketing LLC and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable license to use the app on Apple devices you own or control, as permitted by the App Store Terms of Service. You retain ownership of content you provide (such as profile photos) and grant us a license to store and display it to your family as the service requires.

10. Termination

You may stop using RootLock at any time; deleting your family removes your family's data from our servers as described in the Privacy Policy. We may suspend or terminate access for violation of these Terms. Sections 6–8 survive termination.

11. Changes to These Terms

We may update these Terms as the service evolves. For material changes we will update this page, change the date above, and notify you in the app. Continued use after changes take effect constitutes acceptance.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law principles. Disputes will be resolved in the state or federal courts located in New Mexico, and you consent to their jurisdiction, except where the law of your place of residence requires otherwise.
