Terms of Service

1. Service Description

RootLock is an iOS parental control and digital wellness application developed by Apexium Marketing LLC. The service operates in two distinct modes:

• Parental Control: Allows parents to configure and monitor their children's iPhone and iPad usage.
• Adult Self-Management: Allows adults to self-manage their digital habits with the assistance of an accountability partner.

RootLock leverages Apple's Family Controls, ManagedSettings, and DeviceActivity frameworks, combined with CloudKit-based real-time partner notifications, to facilitate digital accountability.

2. Subscription Terms

RootLock requires an active subscription to access its features. By subscribing to the "RootLock Family" subscription (Product ID: com.rootlock.family.monthly), you agree to the following terms, as required by Apple:

• Title of Service: RootLock Family
• Length of Subscription: Monthly
• Price: $9.99 USD per month
• Payment: Payment will be charged to your Apple Account at confirmation of purchase. Apexium Marketing LLC never receives or stores your credit card numbers or billing address.
• Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period, and identify the cost of the renewal ($9.99 USD).
• Subscription Management: Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase.
• Free Trial: A 14-day free trial is available for new subscribers only. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to RootLock, where applicable.
• Refunds: All refunds are handled exclusively by Apple in accordance with Apple's refund policy. Apexium Marketing LLC does not possess the authority to issue direct refunds.
• Family Sharing: When enabled, a single subscription purchase propagates to your Apple Family Sharing members.

3. Account and Roles

RootLock utilizes your Apple ID for authentication. No separate RootLock account is required or created. Users may operate under four roles: Parent, Child, Adult, or Partner (with UI variants of Partner labeled as "Pastor" or "Sponsor"). While multiple roles can be supported on a single device, specific conflicting combinations (such as Adult and Child on the same device) are restricted to ensure framework stability.

4. Acceptable Use Policy

As a user of RootLock, you agree that you will NOT:

• Use RootLock to surveil, track, or monitor non-consenting adults.
• Configure RootLock on a third party's device without their explicit knowledge and consent (with the strict exception of a parent or legal guardian monitoring a minor child).
• Use RootLock to harass, stalk, coerce, intimidate, or abuse any individual.
• Attempt to reverse engineer, decompile, or otherwise bypass the application's software enforcement mechanisms.
• Resell, redistribute, or sublicense access to the RootLock subscription.
• Use the service for any unlawful or illegal purpose.

5. User Consent Requirements

RootLock strictly enforces consent mechanisms based on the chosen use case:

• Parent Monitoring Child: Verifiable parental consent is provided by the parent on behalf of the minor during the physical, in-person setup of the child's device.
• Adult Accountability: Both the monitored adult and their accountability partner must explicitly opt-in. The adult initiates an 8-character invite code, and the partner must enter this code and explicitly accept the Apple CKShare prompt. Neither party can be added or monitored without explicit, bilateral consent. In "Strict Mode," only the accountability partner can disable monitoring, preventing the monitored adult from removing accountability measures unilaterally.

6. Service Availability Disclaimer

RootLock is provided on an "AS IS" and "AS AVAILABLE" basis. Apexium Marketing LLC makes no guarantees regarding continuous uptime, absolute accuracy, or fitness for a particular purpose.

The service relies entirely on third-party infrastructure provided by Apple Inc. (including iCloud, CloudKit, APNs, Family Controls, and StoreKit). Outages, deprecations, or behavioral changes to these Apple services are outside the control of Apexium Marketing LLC and may affect RootLock's functionality.

The target delivery time of ~30 seconds for bypass notifications is a best-effort estimate. Actual delivery times depend on Apple's Push Notification service (APNs) and local device conditions (network connectivity, battery state, Do Not Disturb settings). Furthermore, RootLock cannot prevent a user from deleting the application from their device (though this will trigger a tamper event).

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APEXIUM MARKETING LLC BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.

Apexium Marketing LLC shall specifically NOT be liable for: data loss; missed, delayed, or undelivered notifications; operating system behavior changes affecting app function; a monitored user successfully circumventing device restrictions; the breakdown of any partnership relationship; or actions taken by Apple Inc. (including App Store removal or billing disputes).

In no event shall Apexium Marketing LLC's total liability to you for all damages exceed the total amount of subscription fees paid by you for RootLock in the twelve (12) months strictly preceding the claim.

8. Intellectual Property

RootLock, its name, the encircled lightbulb logo with 6 dots, and all associated source code are the exclusive property of Apexium Marketing LLC. Apple's trademarks (including App Store, Apple, iPhone, iPad, and iCloud) are the property of Apple Inc. By using the app, you grant Apexium Marketing LLC the necessary licenses to operate the service and process your data purely in accordance with our Privacy Policy.

9. Termination

You may terminate this agreement at any time by canceling your subscription via Apple Settings and deleting the application from your device(s). Upon termination, your data remains safely stored in your own iCloud account under your control. Apexium Marketing LLC reserves the right to terminate or suspend your access to the service for material violations of these Terms, particularly the Acceptable Use Policy.

10. Changes to Terms

Apexium Marketing LLC may update these Terms from time to time. Material changes will be communicated with reasonable notice via in-app notifications. Continued use of the RootLock app after updates constitutes your acceptance of the revised Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law principles.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

Class Action and Jury Trial Waiver: YOU AND APEXIUM MARKETING LLC AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL, OR THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.
